Terms of Service

1. Introduction and Acceptance

These Terms of Service ("Terms") govern your access to and use of AtelierBound, an online listing directory and enquiry platform for art, craft, writing, and culinary retreats and workshops (the "Platform"), operated by Manor & Maker SAS, a French simplified joint-stock company (société par actions simplifiée) registered in Périgueux under SIREN 985 232 529, with its registered address in Dordogne, France ("we", "us", or "the Operator").

By creating an account on AtelierBound, submitting a listing, or using the Platform in any capacity, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not accept these Terms, you must not use the Platform.

These Terms apply to all users of the Platform, including hosts (retreat and workshop providers who pay to list) and guests (individuals who browse and make enquiries). Where provisions apply specifically to hosts or guests, this is stated clearly.


2. Nature of the Platform

AtelierBound is a listing directory and intermediary for contact. It enables hosts to publish information about their retreats and workshops, and enables guests to browse listings and contact hosts directly.

AtelierBound is not a booking agent, travel agent, or payment processor. The Operator does not take bookings on behalf of hosts, does not process payments between hosts and guests, and is not a party to any contract formed between a host and a guest. All booking arrangements, pricing, availability, and payment terms are agreed directly between hosts and guests, outside of the Platform.

The Operator makes no guarantee that a host will accept an enquiry, that a retreat will proceed as described, or that a booking will be confirmed. The Operator bears no responsibility for any transaction, dispute, or failure arising from a direct arrangement between a host and a guest.


3. Accounts and Registration

3.1 Account Creation

To access Platform features, including submitting a listing or sending an enquiry, you must create an account. When registering, you agree to provide accurate, current, and complete information and to keep that information up to date.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us promptly at info@atelierbound.com if you suspect any unauthorised use of your account.

3.2 Eligibility

You must be at least 18 years of age to create an account and use the Platform. By registering, you confirm that you meet this requirement. Hosts operating as businesses confirm that they have the legal authority to bind their organisation to these Terms.

3.3 Account Suspension and Termination

The Operator reserves the right to suspend or terminate any account, at its discretion, where there is reason to believe that a user has violated these Terms, submitted false or misleading information, or acted in a manner harmful to other users or to the Platform. Users whose accounts have been terminated may not re-register without prior written consent from the Operator.


4. Host Listings and Subscriptions

4.1 Listing Tiers and Fees

Hosts pay to list their retreats and workshops on the Platform under one of the following arrangements: a one-time listing fee (Listing or Featured Listing tiers), an annual subscription (Annual tier), or a monthly subscription with a minimum commitment period (Fully Managed tier). Current tier descriptions and pricing are published on the Platform's pricing page. By purchasing any listing tier, hosts agree to the pricing, payment, and renewal terms set out at the time of purchase.

Subscription fees are invoiced by Manor & Maker SAS. For hosts registered for VAT in France, 20% TVA is applied. For hosts in other EU member states, the reverse charge (autoliquidation) mechanism applies. For hosts outside the EU, applicable tax treatment will be confirmed at invoicing. It is the host's responsibility to ensure that the billing details provided are accurate and up to date.

4.2 Founding Host Period

During the Platform's founding phase, listings may be made available at a reduced rate, as published on the Platform's pricing page at the time of registration. Founding hosts will receive advance written notice before standard subscription pricing commences. Participation in the founding period does not create any right to continued reduced-rate listing beyond the stated period.

4.3 Listing Standards and Approval

All listings are subject to review and approval by the Operator before publication. The Operator reserves the right to decline, remove, or require amendments to any listing that does not meet the Platform's content and quality standards, as set out in the Host Listing Guide published on the Platform.

Hosts are responsible for ensuring that their listings are accurate, complete, up to date, and compliant with applicable law, including any requirements relating to consumer rights, licensing, health and safety, or data protection. The Operator does not verify the accuracy of listing content and accepts no liability for inaccurate or misleading listings.

4.4 Content Ownership and Licence

Hosts retain ownership of all content they submit to the Platform, including text, images, and other media. By submitting content, hosts grant the Operator a non-exclusive, royalty-free, worldwide licence to display, reproduce, and distribute that content on the Platform and in associated promotional materials, for the duration of the listing subscription and for a reasonable period thereafter.

Hosts warrant that they own or have the right to use all content they submit, and that such content does not infringe any third-party intellectual property rights or violate any applicable law. The Operator may remove content that it reasonably believes to be infringing or unlawful.

4.5 Renewal, Expiry, and Cancellation

One-time listings (Listing and Featured Listing tiers) do not renew. A listing expires when the retreat's end date has passed, or after 12 months from publication where no end date is specified. Expired listings are not publicly visible. The host's account and listing data are retained for 90 days following expiry, during which the host may publish a new listing. Each one-time listing on AtelierBound covers one event. When this year's retreat is complete and you are ready to open bookings for next year, that is a new listing fee. What carries over is the URL: your listing keeps its address, and with it any search positioning it has built up. For a retreat that runs year after year, that accumulated SEO equity is worth having, and it is yours to keep.

Annual subscriptions run for one year from the date of activation. Hosts will be notified by email at least 30 days before the renewal date. If a subscription is not renewed, the account will be deactivated at the end of the subscription period. Deactivated accounts and listing data are retained for 90 days, during which the host may reactivate by renewing their subscription.

Fully Managed subscriptions are billed monthly with a minimum commitment of three months. After the minimum term, the subscription continues on a rolling monthly basis and may be cancelled by the host with 30 days' written notice to info@atelierbound.com. The Operator may also terminate a Fully Managed subscription with 30 days' written notice. Cancellation takes effect at the end of the notice period; no partial-month refunds are issued.

The Operator reserves the right to adjust subscription pricing at each annual renewal, with a minimum of 30 days' written notice before the renewal date.

4.6 Refund Policy

Subscription and listing fees are non-refundable once a listing has been activated and published on the Platform, except where required by applicable law. Hosts who are unable to publish a compliant listing may, at the Operator's discretion, be offered a credit or pro-rated refund. Any disputes regarding fees should be raised in writing to info@atelierbound.com within 14 days of invoicing.


5. Guest Use of the Platform

Guests may browse listings and create accounts on the Platform without charge. Guests may use the on-platform messaging system to contact hosts directly regarding their retreats. Guests are responsible for the content of their messages and for all direct arrangements made with hosts.

The Platform provides information submitted by hosts and does not endorse, recommend, or guarantee any listing or host. Guests are encouraged to conduct their own due diligence before making any booking or payment with a host.

AtelierBound does not process or handle any payment between guests and hosts. Any booking payments are made directly to the host, outside of the Platform, and the Operator bears no responsibility for such transactions.


6. Acceptable Use

By using the Platform, you agree that you will not:

  • submit false, misleading, or fraudulent information
  • use the Platform for any unlawful purpose or in a manner that violates the rights of any third party
  • post content that is defamatory, offensive, hateful, discriminatory, or otherwise harmful
  • use the Platform to send unsolicited commercial communications to other users
  • attempt to gain unauthorised access to any part of the Platform or to another user's account
  • use automated tools or bots to scrape, copy, or harvest data from the Platform
  • interfere with or disrupt the Platform's technical infrastructure
  • use the Platform in a way intended to circumvent the subscription model, including directing enquiries off-platform to avoid listing fees

The Operator reserves the right to take any action it deems appropriate in response to a breach of these provisions, including removal of content, suspension of accounts, and referral to appropriate authorities.


7. Intellectual Property

The AtelierBound brand, logo, design, and all original content produced by the Operator are the intellectual property of Manor & Maker SAS and are protected by applicable copyright, trade mark, and other intellectual property laws. Nothing in these Terms grants any user a right or licence to use the Operator's brand or proprietary materials except as expressly stated.

The Platform's software infrastructure is provided by Sharetribe Oy (Finland). The Operator's use of the Sharetribe platform is governed by its agreement with Sharetribe Oy; users of AtelierBound are not in a contractual relationship with Sharetribe Oy.


8. Reviews

Guests who have made contact with a host via the Platform's messaging system may submit a review of that host's retreat or workshop. Reviews must be honest, based on genuine experience, and comply with the Platform's acceptable use standards. The Operator reserves the right to remove reviews that it believes to be fraudulent, defamatory, or in violation of these Terms.

Hosts may not solicit, incentivise, or require guests to submit positive reviews. Reviews represent the opinions of individual users and not of the Operator.


9. Limitation of Liability

To the fullest extent permitted by applicable law, the Operator's liability to any user in connection with the Platform is limited to direct losses that are a reasonably foreseeable consequence of a breach of these Terms, and shall not in any event exceed the amount paid by the user in subscription or listing fees in the 12 months preceding the event giving rise to the claim.

The Operator does not accept liability for: (a) loss or damage arising from the actions or omissions of hosts or guests; (b) inaccuracies in listing content submitted by hosts; (c) any transaction or dispute between a host and a guest; (d) any failure or interruption of the Platform due to circumstances beyond the Operator's reasonable control; or (e) any loss of data, revenue, or opportunity, whether or not the Operator was advised of the possibility of such loss.

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other matter that cannot lawfully be excluded or limited. Where users are consumers under applicable EU or French law, statutory rights that cannot be excluded by contract are unaffected.


10. Disputes Between Hosts and Guests

The Operator is not a party to any contract or arrangement between a host and a guest. In the event of a dispute between a host and a guest, the Operator is not responsible for resolving that dispute, and neither party may hold the Operator liable in connection with it.

The Operator may, at its sole discretion, offer informal assistance in communication between parties, but has no obligation to do so and such assistance does not constitute legal advice or mediation.


11. Governing Law and Jurisdiction

These Terms are governed by French law. Any dispute arising out of or in connection with these Terms that cannot be resolved amicably will be subject to the exclusive jurisdiction of the courts of Périgueux, France, except where mandatory provisions of consumer law in the user's country of residence require otherwise.

12. Changes to These Terms

The Operator may update these Terms from time to time to reflect changes in the law, the Platform's features, or its commercial model. Users will be notified of material changes by email or by a prominent notice on the Platform at least 14 days before the changes take effect. Continued use of the Platform after the effective date constitutes acceptance of the revised Terms.

Where changes are required by law and do not disadvantage users, they may take immediate effect without advance notice.
